The placement and purchase of an order with NIPPON POWERŽ constitute the acknowledgment and acceptance of all terms and conditions listed below. NIPPON POWERŽ reserves the right to make changes to its website and terms and conditions at any time.

Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrange me nt thereof, are the sole property of NIPPON POWERŽ, Copyright Š 1998-2006, ALL RIGHTS RESERVED. All images, audio and video clips are the sole property of NIPPON POWERŽ or their respective content provider. You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any me ans without NIPPON POWERŽ's prior written permission. All rights not expressly granted herein are reserved. PRICES All prices listed in our website, advertisement and/or catalog do not include shipping & handling charges. All prices are mail order prices; extra fees may apply for pick up or will call. All prices and descriptions are subject to change without notice. Orders shipped to Florida residents must include 7% sales tax.

TYPOGRAPHICAL ERRORS In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from the supplier or manufacturer, NIPPON POWERŽ shall have the right to refuse or cancel any order placed for product listed at the incorrect price. NIPPON POWERŽ shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, NIPPON POWERŽ shall immediately issue a credit to your credit card account in the amount of the charge.

WARNING All parts sold by NIPPON POWERŽ, except for street legal/DOT approved parts, are racing parts for off road use only. Federal and many State laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting the vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. NIPPON POWERŽ shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. NIPPON POWERŽ shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. NIPPON POWERŽ will not cover any loss in profit or labor due to errors in shipping, mispackage, and/or extended delays for backorder items. NIPPON POWERŽ shall not be held accountable for any misconception or disappointment associated with any product.

SPECIAL ORDERS NIPPON POWERŽ will determine special order items. All special ordered items must be prepaid before processing your order. Special ordered items cannot be cancelled or returned.

CANCELLATIONS Any order which is cancelled with NIPPON POWERŽ after 24hrs from placement of order to the time of shipment will be subject to a cancellation fee of 6% (six percent).

PAYMENT NIPPON POWERŽ accepts all major credit cards, Western Union , checks, money orders, and certified checks payable to NIPPON POWERŽ. Bank transfers also accepted; $25.00 transfer service fee will apply. All checks will be subject to a minimum of (14) fourteen-business day waiting period to clear with our bank. Orders will not be processed or shipped until this waiting period is over. To eliminate this delay, please send a money order, cashier's check, and certified check or prepay by credit card. NSF Checks will be subject to a $10 return check fee to your account. Credit card fraud will not be tolerated. All orders paid by credit card must be shipped to the cardholder's billing address or verified alternate shipping address. Orders will NOT be shipped if the address provided does not match the records of the credit cardholder's bank. Please DO NOT send cash, as we are not responsible for any loss that may occur with the US Postal Service.

SHIPPING All orders are shipped by either UPS or US Postal Service. In stock items usually ship within 24hrs after receipt of order. NIPPON POWERŽ does not guarantee on time deliver for out of stock items. Any expected shipment dates given to customer are approximate. Out of stock items will be placed on backorder. Backorder items will ship within 24hrs after receipt of shipment from manufacturer. Shipping fees calculated by our shopping cart system are estimated. Shipping fees may be higher than stated by our shopping cart system for products using oversized boxes, multiple box shipments and backordered items.

REJECTION OF GOODS As soon as the goods are delivered to Buyer, he shall inspect them. Notice in writing must be given within five (5) days after receipt of goods of any defect or omissions. Failure to give notice within five (5) days after receipt shall constitute an irrevocable acceptance of the goods.

CLAIMS Claim for defective goods, shortages, incorrect items, delays, or failures in shipment or delivery, or for any other cause, shall be deemed waived and released by Buyer, unless made in writing within five (5) days after the arrival of the goods.

RETURNS All items returned are subject to a 25% (twenty-five percent) restocking fee. Returns are not accepted on ignition systems, computers, electrical items, bulbs, lighting accessories, software, engine components, fuel pumps, special orders and custom orders. All other returns or exchanges are accepted within 30 days after date of invoice. All returns must be unused, in the same condition as sold to buyer and in its original packaging. Returned parts with missing packaging, instructions, or parts will be subject to a restocking fee. It is the customers responsibility to contact NIPPON POWERŽ within this time period to be eligible for a return. A (RA#) Return Authorization Number must be issued before returning product. You may contact us by way of telephone at 305-805-1321, fax 305-805-1332. A RA# must be clearly marked on return packages, otherwise package will be refused. The returned item(s) must be accompanied with a copy of the original invoice. No returns or exchanges will be allowed if the item shows signs of having been installed, scratched, damaged or modified. Wheels and tires, which have been mounted, are not returnable. If NIPPON POWERŽ does not accept a returned item as being defective and/or returnable for any reason, the buyer must accept any incurred cost. It is the responsibility of the customer to verify the correct part before ordering and installing a particular part. NIPPON POWERŽ is not responsible for shipping costs incurred by the customer for returning products for return, refund, exchange, and/or warranty.

REFUNDS A refund, exchange or core return will not be made until all items are returned to NIPPON POWERŽ. Shipping and handling charges are non-refundable. Orders placed by credit card will be refunded to the same credit card account only. All other non-credit card orders will be refunded by either company check or store credit. Refused shipments sent back to NIPPON POWERŽ do not constitute a refund or credit. NIPPON POWERŽ reserve the right to charge the customer shipping & handling costs for the refused shipment and a 25% restocking fee.

INTERNATIONAL ORDERS All orders outside of the United States must be paid in full by bank wire transfer (must add $25.00 to order) or Western Union in US Funds before any order will be processed. All foreign orders are final. No returns will be accepted; therefore it is the buyer's responsibility to order the correct part. NIPPON POWERŽ does not guarantee proper fitment for buyer's foreign vehicle as all parts sold by NIPPON POWERŽ are made for the American domestic market.

WARRANTY All products sold by NIPPON POWERŽ are only subject to the manufacturer's warranty. Manufacturer warranty will not be honored if the customer’s mishandling, abuse or faulty installation causes the defect.
